"Do not kill even the infidel without giving him the natural right of every man") shows how Somali society cares for the freedom of the individual. Hence, this paper briefly describes the role in society of some Somali Judicial Systems with discussions about the Heerbeegti institution, which dispensed the customary law, and about the Supreme Court of the Somali Republic (1960-1969), which had also constitutional power. Qoraalkani wuxuu ka hadlayaa dowrka xeerkii hore ee soomaalida, gaar ahaan xigmada ay xeerbeegtady ku maamuli jirtay beesheeda iyo ciddii kale aan ka tirsanayn beesha, sida laga dheehan karo maahmaahdan"Gaalka dil gartiisana sii". Il titolo, un proverbio somalo (in. ita "Non uccidere nemmeno l'infedele senza concedergli il diritto naturale di ogni uomo") dimostra come la società somala tenga particolarmente alla libertà dell'individuo. Dunque, questo documento descrive brevemente il ruolo nella società di alcuni sistemi giudiziari somali, trattando in particolar modo l'istituzione Heerbeegti, che dispensava il diritto consuetudinario, e la Corte Suprema della Repubblica somala (1960 e il 1969), che disponeva anche di poteri costituzionali. |
